Online Auction Terms and Conditions1. Registration and Bidding Rules
- EstateSales.org Profile: Bidders must maintain a valid credit card on their EstateSales.org profile to place bids.
- Binding Contract: Every bid placed is a legally binding and irrevocable contract to purchase the item at the bid amount plus applicable fees.
- Soft Close Feature: This auction uses a "soft close." Any bid placed within the final 2 minutes of an item's closing time will automatically extend the bidding window for that item by an additional 2 minutes to prevent sniping.
2. Item Condition ("As-Is, Where-Is")
- No Guarantees: All estate items are sold "AS-IS, WHERE-IS" with no warranties, express or implied, regarding condition, authenticity, or working order.
- Inspection Responsibility: Written descriptions, dimensions, and photos are meant as general guides only. It is the buyer's responsibility to look closely at all photos and ask questions prior to bidding.
- No Returns: All sales are final. No refunds, credits, or exchanges will be issued for items that do not meet your expectations or do not fit your transport vehicle.
3. Invoice, Taxes, and Buyer’s Premium
- Buyer's Premium: A buyer’s premium of 15% will be added to the final hammer price of each item.
- Sales Tax: Local state sales tax of 0 % will be applied to the total invoice amount unless you upload a valid resale tax certificate to your account prior to bidding.
- Automatic Payment: At the conclusion of the auction, the credit card on your EstateSales.org profile will be automatically charged for your winning invoices. Or, you may use Venmo. Go to auction #100 for details
Local Pickup Policy 1. Schedule and Location
- Designated Pickup Window: Local pickup is available
- Location Access: The exact estate location address will be sent directly to winning bidders via their post-auction invoice email.
2. Loading and Packing Labor
- Bring Your Own Help: You must bring your own labor, tools, and dollies to remove heavy items. Auction staff may assist with lifting, carrying, or securing items.
- Packing Materials: You must bring your own boxes, bubble wrap, paper, or blankets. Packing materials will not be provided on-site.
Shipping and Fulfillment Policy
1. Eligible Items
- Shipping Availability: Shipping is only available for items explicitly marked with the "Shipping Available" icon on the listing.
- Address Match: Items will only be shipped to the verified billing address listed on your EstateSales.org bidder profile.
2. Costs and Handling
- Buyer Expenses: The buyer is entirely responsible for all packing materials, carrier shipping charges, and required transit insurance fees.
- Handling Fee: A flat processing and handling fee of $5 per invoice will be added to all shipped orders. This is to cover sturdy shipping box and packing.
- Processing Timeline: Shipped items will be securely packed and turned over to the carrier USPS / UPS for large items within 5 to 7 business days following the conclusion of the local pickup dates.
Default and Abandonment Policy
- Abandoned Pickup Lots: Any items paid for but not collected by the end of the designated local pickup hours will be considered permanently abandoned.
- No Refunds for Forfeiture: Forfeited or abandoned items will be disposed of, donated, or resold by the auction team. No refunds, partial refunds, or chargeback allowances will be given for abandoned items.
- Account Suspension: Failure to pick up items or non-payment of invoices will result in a permanent ban from our future auctions and a report filed with EstateSales.org, which may suspend your global bidding privileges.
