By registering to bid, placing a bid, or completing a purchase in this online auction hosted on EstateSales.org, you agree to be bound by these Terms and Conditions. These terms are designed to ensure a fair, transparent, and efficient process for all participants. Please read them carefully before bidding. We reserve the right to update these terms at any time, with changes posted to the auction listing.
1. Registration and Bidding- **Eligibility**: Bidders must be 18 years or older and register with valid contact information (name, email, phone number, and shipping address if applicable). We reserve the right to verify identities and reject or block bids from any participant at our discretion.-
**Bidding Process**: All items start at the listed bid amount and are sold to the highest bidder at auction close. The system uses proxy bidding (maximum bid), so you only pay up to the amount needed to outbid others. Bids are binding and cannot be retracted. By placing a bid, you acknowledge that you have reviewed the item photos, descriptions, and condition.-
**Buyer's Premium and Fees**: A 15% buyer's premium will be added to the final bid price.
**Auction Close**: Items close at the scheduled time(s) listed on the auction page. Extended bidding may apply for last-second bids to prevent sniping.
2. Item Condition and Sales Policy- **As-Is, Where-Is Sales**: All items are sold **AS-IS, WHERE-IS, and AS-SHOWN** in the provided photos. Descriptions are for guidance only and based on visual inspection—
**No warranties or guarantees** are made regarding condition, authenticity, functionality, provenance, or fitness for any purpose. It is the bidder's sole responsibility to inspect photos thoroughly and ask questions before bidding. We encourage reviewing high-resolution images and zooming in for details.-
**No Returns or Refunds**: **All sales are final**. There are no returns, exchanges, or refunds for any reason, including buyer's remorse, condition discrepancies, or errors in bidding. Bidders assume all risk of loss or damage upon winning the auction.
3. Payment- **Due Date**: Full payment (including buyer's premium and applicable shipping fees) is due within **24 hours** of auction close. Invoices will be emailed automatically via EstateSales.org.-
**Accepted Methods**: Credit/Debit Card via Stripe, PayPal or Cash at pickup. Online payments are preferred and processed securely. Late payments may result in forfeiture of items and a ban from future auctions.
4. Pickup and Removal- **Timeline**: Winning bidders must arrange and complete pickup **within 7 days** of auction close. Items not picked up within this period will be considered abandoned, forfeited without refund, and may be donated, discarded, or resold at our discretion. You will remain liable for any outstanding balance.-
**Location and Arrangement**: As this is a remote auction, pickup is **by mutual arrangement only**. We work remotely and do not host pickups at a fixed location. Upon winning, you will receive instructions via email to contact us (phone/email) within 24 hours to schedule a convenient time and public meeting spot (e.g., local shopping center parking lot, or similar safe, accessible public space). All pickups will occur during daylight hours for safety. You must provide your own vehicle, boxes, packing materials, and assistance for loading—
**No loading help provided**. Please bring appropriate tools, padding, or strong backs for safe transport, especially for fragile or heavy items.-
**Local Porch Delivery Option**: For local winners (within 20 miles of 08108, porch delivery is available for a flat fee of $50 per trip, payable in advance. This service drops items curbside/porch only—no entry into your home or unloading assistance. Inquire before bidding to confirm availability and fees.-
**No-Shows or Delays**: If you cannot pick up as scheduled, notify us immediately in writing. Alternative arrangements may be possible but are subject to a rescheduling fee of $20 and availability. Failure to communicate may result in forfeiture.
5. Shipping and Insurance- Shipping, packaging, and insurance are **available for select items only** (e.g., small, lightweight, non-fragile goods—large furniture or hazardous materials excluded). We partner with the local UPS Store for larger items.
**Process and Fees**: **Inquire before bidding** via email or phone for a custom quote, as costs vary by item size, weight, destination, and carrier (typically $10–$50+ per item, plus insurance). Once quoted and approved, you must pay shipping fees upfront. We handle packing but are not liable for carrier errors—insurance is strongly recommended and covers up to the item's sale price.-
**Timeline**: Shipping arrangements must be confirmed within 48 hours of auction close; otherwise, local pickup is required. Items not claimed for shipping within 7 days follow the abandonment policy above.
6. Liability and Disclaimers- **Risk of Loss**: Risk transfers to the buyer immediately upon auction close. We are not responsible for loss, damage, theft, or deterioration after this point.-
**Limitation of Liability**: Our total liability shall not exceed the purchase price paid. We disclaim all warranties, express or implied.-
**Dispute Resolution**: Any disputes will be handled informally first; unresolved issues fall under the laws of New Jersey.
7. General Provisions- **Conduct**: Bidding constitutes agreement to act in good faith. Disruptive behavior, shill bidding, or violations may result in immediate account suspension and legal action.-
