Estate Auction Sale Terms: All photos show auction items available in individual lot. Fixtures, lighting and appliances that may be in photos are NOT included in the sale. If there are any questions about what is included, please contact us PRIOR to bidding.

Auction Closes: Thursday, August 24, 2017 at 9:00pm. Closing will be extended 5 minutes when a new bid comes in within 5 minutes of lot closing.
PICK UP: For those doing local pickup All contents must be removed from the autobody shop on Friday, August 25, 2017 1-3:00 PM (no exceptions other than large lifts must be removed by Tues Aug 22, 2017 ) . All others will be shipped and you will receive a second invoice billed separately. The first invoice to include the hammer price, buyers premium, and fl sales tax if applicable must be paid before your item is sent to our shipping dept. You MUST communicate with us regarding payment and pick up plans within 24 hours of auction end - you will be emailed a invoice from estatesales.org and and invoice from swuare so you may pay online with credit card . Agreeing to our terms and conditions is a contract in which you will be held responsible for. If payment is not made as agreed in our Terms and Conditions, Class Act Auctioneers, Inc. has the right to pursue collection of the entire unpaid balance of your purchase and collection fees associated with pursing payment for this auction either thru a bill collection services and/or legal action with the registered bidder of this auction. Class Act Auctioneers, Inc. has endeavored to fully and completely describe the merchandise in its text and photographs and warrants that each photo represents the actual item offered. Much of the photography was performed on site, with color corrected or natural lighting. Inspection: Inspection of the merchandise is encouraged and is by preview times stated in the auction description. Auctions items that are used/antiques/vintage are not guaranteed to be in mint condition. Some items may have minor flaws to include: scratches, crazing, chipping, discoloration, or odor. The Bidder is responsible for knowing which items they are bidding on. Auctioneer will not honor 'mistakes'. Bidder assumes all responsibility for any bidding executed under their EstateSaes.org registered user account during this auction. It is the bidder's responsibility to ensure that their children, cats, dogs, ghosts, and any other applicable excuses or situations do not cause unwanted bids. Class Act Auctioneers, Inc. will not honor such mistakes. Bidder should close application when not in use. *** ***All unpaid invoices will be reported to Estatesales.org. Users reported for unpaid invoices are considered, Black Listed by EstateSales.org, and are disallowed from participating in any other auctions until balance of payment is made. In the event that a dispute arises over the bidding, purchase, terms, conditions, or events of the auction, Class Act Auctioneers, Inc. shall be entitled to recover, any and all cost, expenses, and attorney's fees incurred, not limited to all appellate proceedings or fees for the enforcement of terms of this contract. The parties also agree that Pinellas County, Florida is the proper venue for all legal actions and Florida Law shall apply. Thus, bidder agrees that this agreement shall be governed by the laws of the state of Florida, with jurisdiction in Pinellas County, Florida. CLASS ACT AUCTIONEERS, INC. is providing internet auction bidding through Estatesales.org, as a convenience to the bidder. Bidder acknowledges and understands that this service may or may not function correctly during the auction. Under no circumstances shall bidder have any kind of claim against CLASS ACT AUCTIONEERS, INC. or its agents or assigns, if the Internet service fails to work correctly before or during the auction. -CLASS ACT AUCTIONEERS, INC. is not responsible for missed bids of any kind. -CLASS ACT AUCTIONEERS, INC. reserves the right to withdraw, pass, or re-catalog items in this auction, or cancel any winning bids. -FOR INTERNET BIDDING-An 15% Buyers Premium is in effect for this auction for all estatesales.org participants. If the buyer fails to fulfill their obligations herein, all deposits and payments made here-under by the buyer shall be retained by Class Act Auctioneers, Inc.as liquidated damages. Buyer remains responsible for full purchase price, fees, taxes and any other fees incurred in the process of enforcing this contract. All sales that are subject to 7.0% FL state sales tax where applicable, must be paid at time of transaction closing. There are only two exceptions: 1-Out of State buyers who will be relocating the purchase(s) out of Florida, who are able to produce all the necessary documentation to support their residence, and completes the proper affidavit. 2-Recognized Dealers who produce and file a valid State of Florida Resale Certificate, and sign a statement indicating this purchase was for the purpose of resale. Buyer agrees to hold Class Act Auctioneers, Inc., and any of its employees against any claims of any nature arising from this auction agreement, including full responsibility and liabilities for themselves, their employees, family members, guests, friends, etc. AGENCY: CLASS ACT AUCTIONEERS, INC.is acting as agent only and is not responsible for the acts of its principles of consignors. DISPUTES: The record of sale kept by the Auction will be taken as final in the event of a dispute. REMOVAL: All items must be removed from the auction site no later than the date specified in our terms (within 1 days after the auction). Removal shall be at the risk, expense and liability of the purchaser. No items can be removed without presenting proper evidence of paid bills of sale. If the buyer does not notify CLASS ACT AUCTIONEERS, INC. of such arrangements within 2 days of the auction date, all purchases are considered abandoned, and will be disposed of with NO compensation to the buyer. ***AUTHENTICATIONS: CLASS ACT AUCTIONEERS, INC.is not responsible for the authenticity of any items sold in the auction. Please be aware that in most cases we do not own the items and in many cases have no way to trace the origin of these items. If a description includes a brand name, we are simply listing what the item says on it. We can be fooled as easily as anyone, so we've stopped trying to guess what is real or fake and are leaving that up to the bidders. If you are not completely comfortable that the item you are interested in is real, then simply do not bid. We will not refund you for any reason after you become the high bidder. All accounts must be settled at the conclusion of the auction (24 hours to settle account) and your credit card will be processed thru Square (invoice will be sent to you with link to pay, payment must be received for the hammer price, buyer's premium and taxes if applicable.
We accept Credit Cards that can be processed via your square invoice. The first invoice (#1) we will send thru EstateSales.org accounting system is for lots won that will include; The hammer price, buyer's premium, and any applicable taxes. A second invoice (#2) will be sent covering just the shipping and handling charges once the first invoice has been paid in full from estatesales.org/Square . Because our shipping department is separate from the auction house we cannot combine the two invoices. (no exceptions).
Please Note: It is your responsibility that invoice #1 be paid within 24 hours of the close of the auction. We send invoice #1 Immediately to you after the auction has ended thru the Estatesales.org accounting system. It will be emailed to your email that was provided by you on your estatesales.org account. We will not be responsible for incorrect email addresses. It is your responsibility to make sure your email address and contact information is current. The buyer (bidder) is liable for all fees/costs associated with the collection of balances due, including collection fees/attorney's fees.
We offer professional packing and shipping services. All packing is done in-house. Once a package is ready to ship it is weighed, measured and processed through the USPS, FEDEX and/or UPS system in order to determine cost of shipping including insurance and additional services (e.g. delivery confirmation) as applicable. Shipping charges include a fee for packing time and materials. If purchased supplies (e.g. boxes) are used, that cost is passed on to the buyer as part of the packing fee. We offer you the option of furnishing your own shipping label, However, you will still be charged for packing materials and labor. The actual cost of shipping/insurance and packing/materials cannot be determined until packing is completed. Once known, the shipping charges are applied to the buyer's invoice and he/she is notified of the cost by invoice via email. In the unlikely event that your item is damaged in transit by the shipping company it will be the responsibility of the winner bidder to file any and all insurance claim. Class Act Auctioneers, Inc. will supply you with any necessary documentation in regards to insurance placed on the item for your claim. Class Act Auctioneers, Inc. will not be responsible financially for any denial of insurance claim by shipping company. We recommend for insurance purposes to keep any and all packing material until your claim is processed by the shipping company.
