GENERAL TERMS FOR ALL SALES
- All items are sold AS-IS, WHERE-IS, with no warranties, guarantees, refunds, returns, exchanges, or chargebacks.
- All descriptions, photos, measurements, counts, and condition notes are provided as a courtesy only. Buyers are responsible for inspecting items and making their own determination of value, condition, authenticity, completeness, and usability.
- All sales are final once an item is purchased, won, paid for, or removed from the premises.
- We reserve the right to correct errors, remove items from sale, combine lots, split lots, cancel bids, reopen bidding, or withdraw any item at any time.
- We reserve the right to refuse service, entry, registration, bidding privileges, bids, or sales to anyone, for any lawful reason, unless prohibited by law.
- Buyers are responsible for all applicable sales tax unless a valid resale certificate or exemption is provided before payment.
- All buyers enter the property or pickup location at their own risk. The company, homeowner, property owner, staff, and representatives are not responsible for accidents, injury, loss, theft, damage, or personal property left behind.
- Buyers are responsible for bringing their own help, tools, boxes, packing materials, dollies, and equipment needed to safely remove purchased items.
- Staff may not be available to assist with loading. Damage caused during removal is the buyer’s responsibility.
LIVE ESTATE SALE TERMS
- Entry may be limited based on space, safety, parking, or crowd size.
- Prices are subject to change at any time during the sale.
- Items are sold on a first-come, first-served basis unless otherwise stated.
- Holding items is at the sole discretion of sale staff and may require immediate payment.
- Purchased items must be removed by the deadline announced at the sale unless prior arrangements are approved.
- Any item paid for but not removed by the stated deadline may be considered abandoned with no refund.
- Please respect neighbors, parking rules, driveways, posted signs, and property boundaries.
ONLINE SALE / ONLINE AUCTION TERMS
- A 20% buyer’s premium will be added to all winning bids and online purchases unless otherwise stated.
- Bids are binding. Do not bid unless you are prepared to pay for and pick up or arrange shipping for the item.
- No bid cancellations will be accepted unless approved by management in writing.
- The highest accepted bid at closing will be considered the winning bid, subject to confirmation and any platform rules.
- Invoices must be paid by the deadline stated on the invoice or sale listing.
- Failure to pay may result in cancellation of the sale, forfeiture of bidding privileges, account restriction, collection action, or resale of the item.
- Pickup dates and times are firm. Buyers must pick up during the scheduled pickup window unless prior written approval is granted.
- Items not picked up by the deadline may be considered abandoned with no refund.
- Shipping may be available on select smaller items only. Shipping, handling, packing, insurance, and any related fees are the buyer’s responsibility.
- We are not responsible for shipping delays, carrier damage, lost packages, or claims once items are released to the carrier.
PAYMENT TERMS
- Accepted payment methods may include cash, credit card, debit card, Zelle, or other approved payment methods depending on the sale.
- Credit card payments may require matching identification.
- Returned payments, declined payments, chargebacks, or disputed payments may result in additional fees and loss of future buying privileges.
- All invoices must be paid in full before items are released.
PICKUP, REMOVAL & ABANDONED ITEMS
- Buyers must remove all purchased items during the posted pickup or removal times.
- Buyer is responsible for safe removal and transportation of all purchased items.
- Any item left after the pickup deadline may be deemed abandoned, resold, donated, disposed of, or otherwise handled at our discretion with no refund.
- Additional storage, handling, disposal, or labor fees may apply for items not picked up on time.
CONDITION, AUTHENTICITY & DESCRIPTIONS
- All items are used, estate-owned, vintage, antique, collectible, or secondhand unless clearly stated otherwise.
- Normal wear, age, damage, missing parts, odors, stains, repairs, or imperfections may be present.
- We do not guarantee age, maker, authenticity, grade, condition, signatures, working order, completeness, or value unless expressly stated in writing.
- Buyers are encouraged to inspect items in person when possible and ask questions before buying or bidding.
FINAL AGREEMENT
By entering a live sale, registering for an online sale, placing a bid, making a purchase, paying an invoice, or removing an item, the buyer agrees to these Terms & Conditions.
