Terms & Conditions 1. General Terms
This is an internet-only auction, and all bidding takes place online. By registering or placing a bid, you acknowledge that you have read, understood, and agreed to these Terms & Conditions in full.
AS-IS, WHERE-ISAll items are sold AS-IS, WHERE-IS, with no warranties or guarantees of any kind, whether expressed or implied. This includes, but is not limited to, warranties regarding condition, authenticity, merchantability, fitness for a particular purpose, completeness, or accuracy of description.
Photographs, titles, measurements, condition notes, and descriptions are provided as a general guide only. Buyers are responsible for reviewing all available information and relying on their own inspection, research, and judgment before bidding.
Finality of SaleAll sales are final. No refunds, returns, exchanges, credits, or price adjustments will be provided.
Rights ReservedKali.J Design, hereafter referred to as the “Auctioneer,” reserves the right to:
Refuse, restrict, suspend, or revoke bidding privileges at any time.
Reject any bid or bidder at its sole discretion.
Bid on behalf of a consignor or the Auctioneer, including bidding up to a disclosed or undisclosed reserve where permitted.
Withdraw, combine, separate, or modify any lot before or during the auction.
Reopen bidding, cancel a sale, or resell an item in the event of a dispute, bidding irregularity, system failure, clerical error, or other technical issue.
Correct errors in listings, descriptions, photographs, lot numbers, invoices, or auction information.
Binding ContractThe highest bid accepted by the Auctioneer constitutes a legally binding purchase agreement. Bids may not be retracted, canceled, or reduced after they are submitted.
2. Buyer’s Premium and TaxesAn 18% buyer’s premium will be added to the final winning bid for each lot.
A 7.75% sales tax will be applied to the final bid amount plus the buyer’s premium unless the buyer provides a valid California resale certificate before the auction closes.
The buyer is solely responsible for all applicable taxes, premiums, shipping charges, handling fees, storage charges, and other costs associated with the purchase.
3. PaymentPayment is due no later than 24 hours after the first scheduled pickup date unless the buyer is paying cash during the scheduled pickup window.
Accepted Payment MethodsCredit or Debit Card: Visa, Mastercard, American Express, and Discover may be processed online. Credit cards will not be accepted for invoices exceeding $2,000.
Cash at Pickup: Exact payment is required. Change may not be available.
Wire Transfer: Required for invoices exceeding $2,000. A $25 wire-transfer fee will apply.
Certified Funds: Cashier’s checks and certified checks may be accepted at the Auctioneer’s discretion.
The Auctioneer may require additional identity verification or an alternate payment method before releasing merchandise.
Failure to PayFailure to pay within the required period may result in:
An attempt to process the payment method registered with the auction platform.
Telephone, email, or text-message contact to collect the outstanding balance.
A restocking or cancellation fee equal to $100 or 25% of the unpaid invoice, whichever is greater.
Resale, disposal, or reassignment of the purchased items.
Immediate suspension or permanent revocation of bidding privileges.
Referral of the account for collection or legal action.
The buyer is responsible for all collection expenses, attorney’s fees, court costs, chargeback fees, administrative expenses, and damages incurred by the Auctioneer as a result of nonpayment.
4. Pickup and RemovalAll purchases must be removed during the following scheduled pickup window:

Buyers must bring their own labor, tools, dollies, boxes, packing materials, tie-downs, vehicles, and any other equipment necessary to safely remove their purchases.
Auction staff assistance with dismantling, carrying, or loading merchandise is not guaranteed. Buyers are responsible for determining whether their vehicle and equipment are appropriate for the items purchased.
Buyers are responsible for any damage they cause to the property, building, fixtures, other merchandise, or surrounding areas during removal.
Abandonment and StorageItems not picked up by the end of the scheduled pickup window may be considered abandoned unless the Auctioneer has approved alternative arrangements in writing.
Abandoned items may be resold, donated, discarded, relocated, or stored at the Auctioneer’s discretion.
A storage fee of $25 per lot, per day may be charged for items remaining after the scheduled pickup period.
Payment of an invoice does not prevent an uncollected item from being considered abandoned. No refunds will be issued for abandoned, resold, donated, disposed-of, or unclaimed merchandise.
5. ShippingShipping may be available for eligible lots at the buyer’s full expense. Certain furniture, oversized items, hazardous materials, fragile merchandise, or pickup-only lots may not be eligible for shipping.
Actual postage, insurance, packaging materials, labor, and a per-lot handling fee will be invoiced separately after the auction concludes.
Shipping RequirementsThe merchandise invoice must be paid in full before a shipping quote is prepared or the order is packed.
Items will be shipped only to the verified billing address associated with the payment method unless the invoice is paid by approved wire transfer and alternate arrangements are accepted in writing.
Shipping charges must be paid within 48 hours after the quote or supplemental invoice is issued.
Insurance and signature confirmation are required for all shipments.
The buyer is responsible for confirming that the shipping address is complete and accurate.
The buyer assumes the risk of loss once the package is accepted by the shipping carrier. Any carrier damage or loss claim must be reported promptly. The Auctioneer may provide reasonable documentation to assist with a claim but does not guarantee the carrier’s approval or payment of the claim.
Items with unpaid shipping charges may be considered abandoned and handled in accordance with the abandonment provisions of these Terms & Conditions.
6. Item Discrepancies and Auction DisputesBuyers must inspect their purchases before leaving the pickup location.
Any claim involving a missing or incorrect item must be reported before the buyer leaves the premises whenever reasonably possible. Shipping-related discrepancies must be reported within 24 hours of delivery.
After the applicable reporting period, all invoices, pickups, shipments, and distributions will be considered complete and final.
Any dispute involving bidding, lot ownership, auction results, technical problems, or sale outcomes will be resolved by the Auctioneer in its sole discretion. Available remedies may include reopening bidding, canceling a transaction, correcting an invoice, or reselling the item.
7. Assumption of Risk, Liability, and IndemnificationParticipation in the auction, pickup, removal, loading, transportation, ownership, and use of purchased merchandise are undertaken at the buyer’s own risk.
By registering or bidding, the buyer agrees to release, defend, indemnify, and hold harmless Kali.J Design, the Auctioneer, property owners, consignors, employees, contractors, representatives, and agents from claims, losses, expenses, damages, injuries, liabilities, or legal fees arising from:
Participation in the auction.
Inspection, pickup, loading, removal, transportation, or use of purchased merchandise.
The condition, operation, safety, authenticity, or suitability of any item.
Damage caused by the buyer, the buyer’s guests, employees, contractors, or transportation providers.
Buyers are responsible for supervising any children, guests, movers, contractors, or other individuals accompanying them during pickup.
8. Technical IssuesThe Auctioneer is not responsible for internet interruptions, platform outages, delayed bids, software errors, device failures, inaccurate countdown displays, email-delivery failures, or other technical problems outside its reasonable control.
The Auctioneer may pause, extend, reopen, cancel, or reschedule the auction when a technical issue may have affected bidding or auction results.
9. Governing Law and VenueThese Terms & Conditions are governed by the laws of the State of California.
Any legal action, claim, or proceeding arising from the auction or the purchase of merchandise must be filed and handled exclusively in San Bernardino County, California.
10. Acceptance of TermsRegistering for the auction, placing a bid, winning a lot, or paying an invoice constitutes the buyer’s full acceptance of these Terms & Conditions.
These Terms & Conditions apply to the Kali.J Warehouse Closing Liquidation Auction, opening Friday, July 17, 2026, and closing Friday, July 24, 2026.
