PAYMENT
1. ALL SALES ARE FINAL, LEGAL, AND BINDING. By bidding on a lot, you are committing to purchasing it. Won lots will be sent an invoice by Sunset State Auctions ("SSA") within 5 business days of auction closing and must be paid within 72 hours. By registering with EstateSales.org, agreeing to these Terms & Conditions, and/or placing bids on our lots, you are committing to purchase and accepting all responsibility for any bids, fees, sales, and transactions and acknowledging that all sales are legal and final.
2. The purchase price payable by the Buyer shall be the sum of the final bid plus a buyer's premium of 20%, 3% in credit card processing fees, all shipping, insurance, and handling fees, and applicable sales tax which will be invoiced after closing of auction. Buyers in Arizona will be charged a sales tax of 9.3%. For more information on shipping, insurance, and handing fees, please see shipping policy below.
3. Invoices not paid in full within 72 hours, will have the credit card on file automatically charged. SSA reserves the right to attempt to charge any invoices "past due" indefinitely. It is at SSA's discretion to attempt to charge the "past due" invoice, to re-list, re-sell, offer to next highest bidder, or do with what they see fit with lots after 72 hours of non-payment has elapsed. SSA reserves the right to attempt to charge winning Bidders until their invoice is fully paid. SSA also reserves the right to delete any won lot(s) from past due invoices and attempt to charge winning Bidder until invoice is paid. SSA can attempt to charge winning Bidder at any lower amount than original invoice total until invoice is paid to SSA's satisfaction. If any won lot(s) are deleted or retracted by SSA, winning Bidder will not receive them.
4. Non-Paying Buyers are taken seriously and SSA reserves the right to disallow them from purchasing or receiving items and can block and/or reject them from future sales. All bids are legal and binding, by bidding you are committing to pay for the lot. SSA reserves the right to pursue and take legal action against Non-Paying Buyers if invoices are not paid in full within 72 hours of invoice being sent. Non-Paying Buyers will also have their account information forwarded to EstateSales.org so they are made aware of bidder fraudulence.
5. It is the Buyer’s responsibility to read all information regarding final purchase price prior to placing any bid. If Bidders needs help calculating a shipping quote, contact us prior to placing a bid. Please note that this quote will only be approximate and will not include handling charges or other final purchase price fees. Bidders acknowledge they can inquire about approximate shipping costs prior to placing a bid. Final purchase price fees and charges, including shipping costs, are not grounds for purchase/transaction cancellation.
6. Buyer may not request invoice cancellations or terminations, refunds of payment, exchanges, or bid revocation for any placed bid or any won lot.
7. SSA reserves the right to cancel or refund some lots or entire invoice transactions in some circumstances such as (but not limited to): item being damaged prior to shipment, item becoming unavailable or unsellable, lot being listed incorrectly or sold by mistake, or determining business cannot be completed with customer. It is at SSA's full discretion to cancel any transactions for any reason.
SHIPPING
Bidders may request a shipping quote prior to closing of auction. Please inquire before placing a bid, as all bids are legal and binding and shipping costs are not grounds for cancelations or refunds. Please note that these are ONLY quotes and actual price may be different.
**The following applies only to the 48 contiguous United States. For shipping questions/quotes to Alaska, Hawaii, or internationally, please contact us**
1. All shipping arrangements will be handled by Sunset State Auctions (SSA). Shipping costs will be included on invoices and will be paid by Buyer. Items are shipped in-house and usually within 10 business days of receiving payment of sale. Large items and artwork may take longer to package and ship. No pickup, will call, or third party shipping is available for any item in any of our auctions.
2. Each lot has its own shipping and insurance cost. Measurements and weights of lots listed in description are prior to being packaged. If you need help calculating a cost, reach out to us before placing a bid. Shipping prices are non-negotiable. SSA is not responsible for costs that shipping carriers charge and Buyers are not permitted to ask for other methods of shipping or a less expensive price. Insurance costs are what the shipping carrier charges to cover the "hammer price" of each lot if something were to happen to the package in transit. This will be included in the shipping cost on the invoice. Insurance is added to every package's shipping cost and is non-negotiable.
3. Each invoice will have a handling fee dependent on amount of lots won. This fee will be in addition to insurance and shipping cost. The handling fees are as follows:
Handling Fees:
$5 for invoices with 1-3 won lots
$10 for invoices with 4-8 won lots
$15 for invoices with 8-14 won lots
$20 for invoices with 15-20 won lots
$5 additional for each increment of 5 won lots thereafter (example: invoices with 32 won lots = $35 in handling fees)
Oversized packages (any one side of package exceeding 20") will be subject to an additional $5-$10 handling fee to cover the cost of its packaging box.
4. Most lots are packaged prior to start of auction, therefore Buyers cannot request separate won lots to be combined for shipping. However, in some circumstances, SSA reserves the right to combine separate won lots for combined shipping to the same buyer and address. In such circumstances, SSA will adjust shipping costs, if any, accordingly for Buyer prior to sending invoice.
5. SSA will choose the shipping carrier at our own discretion. Buyers are not permitted to request a specific shipping carrier. If there is an issue with Buyer’s shipping address or information, it is their responsibility to contact SSA prior to shipment. If a Buyer does not receive deliveries from certain carries, it is their responsibilities to inform SSA prior to paying invoice. Shipping addresses and destinations cannot be altered once invoice has been paid and no refund will be issued.
6. SSA tries our best to ensure all items arrive safely to their destination. We understand that once out of our hands, the package and its contents are out of our control and for this reason, all packages are shipped with insurance. SSA is not responsible for damage, issues, or missing/lost/stolen items or lots after shipment, regardless of cause.
GENERAL POLICY
1. All items offered at auction are sold "AS-IS", where is, no refunds, no returns and without recourse. All descriptions are based on the opinion of Sunset State Auctions (SSA). Descriptions including photographs, condition, weights, authenticity, provenance, manufacturer, artist, origin and measurements are believed to be accurate, however, neither SSA, the auctioneer, nor consignor makes any warranty or representations of any kind to the merchandise being offered. All measurements and weights are approximate. SSA encourages contacting us (sunsetstateauctions@gmail.com or through EstateSales.org messaging) pre-auction for additional information on desired lots. It is the responsibility of the prospective Bidder to inspect the goods and determine exact condition of each item.
2. SSA is not responsible for any omission or errors in the description, or a further verbal or written description given by the auctioneer(s) the day of the auction or by any employee preceding or following the auction.
3. SSA encourages all potential Bidders to preview items and lots online prior to placing a bid. Further condition information may be available upon request. Please inquire using EstateSales.org messaging or email us at sunsetstateauctions@gmail.com at before placing a bid. Prospective Bidder and Buyer acknowledges that they have the right to take advantage of inquiring prior to placing a bid and sale of lot to determine the authenticity, condition, size, repair or restoration of any item or lot.
4. All items and property are sold "AS-IS". SSA strives to provide the most accurate description and item condition, however, SSA makes no warranty of title, merchantability or fitness for a particular purpose, or any other warranty or representation regarding the description, genuineness, authenticity, attribution, provenance or condition to the item of any kind or nature with respect to the item. SSA will not guarantee the authenticity of any autograph or signature unless so stated at the time of auction. We are not responsible for typographical errors. Bidders are encouraged to do their due diligence prior to placing a bid and bid at their own discretion.
5. SSA makes no warranties as to finite value for items(s) sold. The Bidder determines the final price. SSA encourages Bidders to do their own due diligence and bid at their own discretion as any and all bids are legal and binding.
6. SSA may include price reserves on any items or lots which they see fit with or without explicit description or acknowledgement. If a lot has a reserve price, Bidders may not inquire about the set price so that all other potential Bidders have a fair and equal opportunity. If any item or lot does not reach the reserve price, it will not sell to the current high Bidder, but instead will be "passed". Current high Bidder will not be charged as no sale has taken place if the reserve was not met.
7. SSA reserves the right to reject any bid or to refuse certain Bidders without any form of acknowledgement or notice.
8. SSA continues to own and hold title of items until it has left our possession for shipment. Highest Bidder assumes title to merchandise once any and all dues are paid AND SSA has shipped items. The purchaser shall assume full risk and responsibility for the lot purchased once title has passed.
9. No auction lot can be shipped until payment has been accepted and cleared. SSA is not responsible for Bidder errors, auction platform errors, electronic device errors, internet errors, phone bidding errors and/or other bidding mishaps or unforeseeable issues. Please see our payment and shipping section for further details.
10. In the event a Buyer does not pay their invoice on time, the second highest bidder on the unpaid lot may be offered the chance to purchase it. This Bidder is entitled to accept or reject the purchase offer. (Note: many, but not all, unpaid lots will be offered as a second chance to next highest bidder).
RETURNS/REFUNDS POLICY
1. No item(s) and/or lots are subject to being returned, refunded, or exchanged in any way. All sales are "as-is" and final.
2. In the event of damage during shipment or lost packages, Buyer will have 24 hours upon confirmed delivery to email SSA (sunsetstateauctions@gmail.com) with any issues. It is the Buyer's responsibility to contact the shipping carrier for the next steps. If SSA is made aware of the issues within 24 hours of confirmed delivery, we will help the Buyer to our best ability with any additional information they may need required by the shipping carrier. It is at the shipping carrier's discretion to choose to reimburse the Buyer or not. SSA holds no responsibility to reimburse or refund the Buyer as insurance has been included in shipment.
