Terms & Conditions: Legacy Auctions & Estate Sales
Welcome to our sale listing! By participating in, purchasing from, or placing bids through Legacy Auctions & Estate Sales (in-person or via our online shop and listing platforms), you agree to abide by the following terms and conditions:
1. General Terms & "As-Is" Sale
- All Sales Are Final: All items are sold AS-IS, WHERE-IS, with all faults, imperfections, and descriptions.
- No Guarantee: We do our best to provide detailed descriptions and clear photos, but we make no guarantees, warranties, or representations of any kind regarding authenticity, condition, age, value, or working order.
- Buyer Responsibility: It is the buyer’s responsibility to inspect items carefully (via photos, descriptions, or asking questions prior to checkout/bidding). No refunds, returns, exchanges, or price adjustments will be issued under any circumstances.
2. Online Shop & Bidding Rules
- Binding Commitments: All online orders and bids are binding contracts. Once an order is placed or a bid is submitted, it cannot be canceled, lowered, or retracted.
- Buyer's Premium & Fees: Online purchases or winning bids may be subject to a buyer’s premium and/or platform processing fees as specified on the listing or product page.
- Payment Deadlines: Online purchases and auction wins must be paid in full within 24 to 48 hours of the sale/auction closing. Failure to pay within the required window may result in the order being canceled, forfeiture of the item, and permanent account suspension from future online sales.
- System Failure Disclaimer: Legacy Auctions & Estate Sales is not responsible for missed bids, technical delays, server outages, or internet connectivity issues during online sales or timed auctions.
3. Shipping, Pick-Up & Removal
- In-Person Pick-Up: Buyers electing to pick up items must do so during the designated pick-up windows and locations provided at checkout or in the winning invoice.
- Moving & Loading: Buyers are solely responsible for bringing their own boxes, packing materials, tools, and labor to disassemble, haul, and load heavy or fragile items. Staff members are not required to assist with moving or loading.
- Shipping Policies:
- Shipping is available on select items where explicitly stated.
- Buyers are responsible for all actual shipping costs, handling fees, and packing materials.
- Items will only be shipped to the billing address associated with the payment method unless prior written approval is granted.
- Legacy Auctions & Estate Sales is not responsible for items damaged or lost in transit by third-party carriers (USPS, UPS, FedEx). Shipping insurance can be added at the buyer’s request and expense.
- Forfeited & Abandoned Items: Any paid items not picked up by the stated pick-up deadline (or without scheduled shipping) will be deemed abandoned and revert to Legacy Auctions & Estate Sales with no refunds or credits issued.
4. Payment Terms & Sales Tax
- Accepted Payment Methods: Major credit/debit cards, cash (for in-person sales), and approved electronic payments.
- Processing Fees: Credit and debit card transactions are subject to standard payment processing fees.
- Sales Tax: Applicable state and local sales tax will be added to all orders unless a valid tax-exempt certificate/resale permit is provided prior to transaction processing.
5. Safety & On-Site Premises Rules
- Enter at Your Own Risk: Buyers and visitors attending on-site pick-ups or estate sales enter the premises at their own risk. Legacy Auctions & Estate Sales, property owners, and estate representatives are not responsible for accidents, personal injuries, lost belongings, or vehicle damage on or around the property.
- Property Respect: Please park responsibly without blocking driveways, mailboxes, or emergency access routes.
- Surveillance: Premises may be under video surveillance. Shoplifting or unauthorized property damage will be prosecuted to the fullest extent of the law.
6. Special Circumstances & Rights
- Right to Refuse Service: Legacy Auctions & Estate Sales reserves the right to refuse service, cancel orders, or revoke bidding privileges from anyone for non-payment, disruptive behavior, or breach of terms.
- Item Withdrawal: We reserve the right to remove or withdraw any item from the online shop or auction prior to payment processing or sale completion.
Quick Tips for Online Shop Deployment:
- Checkout Integration: Add an explicit "I agree to the Terms & Conditions" checkbox during the online checkout/bidding registration flow.
- Shipping vs. Pick-Up Only: Mark items clearly in your store listings as "Local Pick-Up Only" or "Shipping Available" to reduce buyer confusion before purchase.
