Before conducting any kind of auction<\/a>, it’s important to make sure you’re compliant with your state’s auction license laws. Here’s a caveat: laws\u00a0can be tricky to interpret\u00a0with\u00a0plenty of “grey” areas. Between auctioneer licenses, business licenses, and online auctions<\/a>, it can be difficult for an auctioneer or estate sale company<\/a> to know what their state’s regulations are. Plus, state laws are constantly being changed or updated – especially when pertaining to online auctions which are fairly new.<\/p>\n

To get you started, we’ve researched the auction license laws in all 50\u00a0states\u00a0to find out what you need to stay legal, as well as provided contact information to get\u00a0your questions answered. Because laws change so frequently, let us know in the comments if you come across information that’s outdated, so we can keep this resource current. Auctioneer License Requirement:<\/strong>
\nAn Auctioneer License is Required. To become and auctioneer, if you are already a resident of the state you must submit the required application. You must also complete an auction school, have two endorsements and pay the required fee of $175.00. This state does allow reciprocity. Business owners must hold auctioneer license.<\/p>\n

Other License for Estate Sale Only Business?<\/strong>
\nYes. The License is called a Privilege License. The State Requires compliance with Section 40-12-101 which requires a this license for the sale of good only if the seller is anyone other than the owner of the goods. \nThere is no auctioneer license requirement in CA. However, California\u00a0does mandate that auctioneers and auction companies must have a bond filed with the state of at least $20,000.00. The CA Department of Insurance maintains a list of current companies that can assist you in obtain a bond.<\/p>\n

\nEstate Tag sales or auctions will require a Sellers Permit to be issued by the Board of Equalization<\/a>. To obtain the permit you must file out an application and pay a fee. Failure to do so could result in fines.<\/p>\n

Online Auction\u00a0License<\/strong>:<\/strong>
\nIf, through Internet auction houses you list your merchandise to sell, seek bids, accept a bid from the highest bidder, and transfer the merchandise to the purchaser, you are generally considered the retailer in your transactions. This is true whether you receive the funds or have another party, such as PayPal, collect the funds on your behalf. Companies that host such transactions are not themselves considered retailers and are therefore not subject to the requirement.<\/p>\n

Auctioneer License Requirement:<\/strong>
\nA State Auctioneer License is required to conduct an auction in West Virginia. To receive the license, one must pay a fee, file an application with the State, be bonded, completed an apprenticeship for two years\/school and 6 months of apprenticeship, and pass an Auctioneer exam. After receiving the license, annual dues must be paid in order to keep the license.<\/p>\n
